Aligarh Muslim University (AMU) is considered one of the most controversial educational institutions in India. It is not just an ancient scientific edifice but also a cultural and social symbol embodying the aspirations and challenges of the Muslim community in India since its establishment in the 19th century until today. With the legal and political developments that India has witnessed over the past decades, questions have arisen regarding the identity of the university, its role as an educational institution for minorities, and the extent of its connection to its Islamic roots. 

 Turning Dream into Reality

In 1877, Muslim social reformer Sir Syed Ahmad Khan established the Muhammadan Anglo-Oriental College (MAO College) in Aligarh to promote modern education among Muslims while preserving Islamic values. This initiative came in the context of educational and social decline faced by Muslims following the fall of the Mughal Empire. The primary goal of establishing this college was to combine modern education, inspired by British models, with the preservation of Islamic identity. 

From the outset, the college was distinguished by its diverse character, as it was open to all communities, although it was primarily established to serve the Muslim community. In 1920, the college became Aligarh Muslim University under the Aligarh Muslim University Act of 1920, which granted it a distinguished academic status. 

 Is It a University for Minorities?

Over time, legal discussions regarding the university's status as a minority institution began to escalate. In 1967, the Indian Supreme Court issued a ruling in the case of Syed Aziz Pasha v. Union of India, stating that Aligarh Muslim University is not a minority institution, arguing that the university was established through parliamentary legislation rather than directly by the Muslim community. The court affirmed that the mere efforts exerted by Muslims to establish the university did not mean it was created by a minority in the legal sense. 

This ruling sparked widespread controversy in academic and political circles, as many Muslims felt that the decision undermined their historical identity and right to manage the university. 

 1981 Amendment: An Attempt to Restore Identity

In 1981, the Indian government sought to address this controversy by amending the university law. The amendment defined the university as an educational institution "established by Muslims in India," and new tasks were added for the university to promote the educational and cultural advancement of Muslims. 

Despite this amendment, legal issues related to the university's status continued. In 2005, the university issued a resolution reserving 50% of postgraduate medical seats for Muslims, based on its status as a minority institution. However, the Supreme Court annulled this decision, relying on the previous ruling in Syed Aziz Pasha's case. 

 Recent Developments: A Battle in the Courts

In 2019, the Supreme Court reconsidered the university's case and referred it to a seven-judge panel to reevaluate the 1967 ruling. In a radical turn of events, the Supreme Court, in 2024, abolished the 1967 ruling, affirming Aligarh Muslim University's right to be considered a minority institution. The court ruled by a majority of 4-3 from the seven-judge panel, led by the Chief Justice of India (CJI), who redefined the criteria for educational institutions for minorities.

 Key Points Discussed in the Ruling

–  Flexible Interpretation of Article (30):  The court emphasized that the interpretation of Article (30) cannot be narrow or purely legalistic; rather, it must consider the historical and cultural context of institutional establishment.

–  Recognition of Minority Rights:  The judges pointed out that the mere existence of legal texts that define the nature of the institution cannot be the only factor in judging its identity. Instead, the intentions and efforts that accompanied the establishment of the university should be considered.

–  Abolition of Time Restrictions:  The ruling confirmed that institutions established before the constitution are not deprived of minority rights, which enhances the inclusiveness of Article (30).

–  Management of Institutions:  The judges stressed that the rights of self-management for minorities cannot be waived or annulled, based on constitutional precedents such as the Pashcher Nath case (1959).

 Agreement and Disagreement Among Judges

Despite differences in some details, there was broad agreement among the seven judges on expanding the constitutional protection for educational institutions for minorities. However, the dissenting judges placed greater importance on the legal texts of the University Act of 1920, considering that to be the decisive factor in determining the university's status. Judge Dipankar Dutta, who joined the dissenting team, highlighted the importance of adhering to previous rulings but acknowledged that a narrow interpretation of the constitution may not align with social and political developments.

 The Future of the University Amid Challenges

The recent ruling by the Supreme Court may represent a significant symbolic victory for the Muslim community, but it also opens the door to new questions about how to manage the university and its role in promoting the cultural and educational identity of Muslims.
